E-Planner
Terms of Service
These terms govern your use of E-Planner in the Republic of South Africa.
E-Planner is a digital estate planning platform.
Our platform helps you organise, document, and plan your estate — including assets, beneficiaries, and legacy instructions — through a secure digital interface.
You may use E-Planner if you are:
- 18 years of age or older
- a natural person with full legal capacity, or a juristic person duly authorised to act
- resident or domiciled in the Republic of South Africa
By creating an account, you confirm you meet these requirements. E-Planner reserves the right to suspend accounts where eligibility cannot be verified.
E-Planner is an information and organisational tool. It is not a law firm, a registered Financial Services Provider (FSP) under the Financial Advisory and Intermediary Services Act (No. 37 of 2002), or executor of estates.
Nothing on this platform constitutes legal, financial, tax, or investment advice. Any insights, projections, or recommendations generated by E-Planner are indicative only. You should consult a qualified attorney, financial adviser, or tax practitioner before making any estate planning decisions.
Documents produced on this platform (including will drafts) are templates only. A valid will under the Wills Act 7 of 1953 requires your signature on every page and two competent adult witnesses. E-Planner does not verify legal formalities and accepts no liability for documents that do not meet statutory requirements.
You are responsible for keeping your login credentials secure. You must not share your account with any other person. Any action taken using your account is your responsibility.
Notify us immediately at info@e-planner.co.za if you suspect unauthorised access to your account.
You retain ownership of all information and documents you upload to E-Planner (“Your Content”). By uploading content, you grant E-Planner a limited licence to store, display, and process it solely to provide our services to you.
We do not sell Your Content to third parties.
We do not use Your Content to train artificial intelligence models without your separate, explicit consent.
You are responsible for ensuring that any information you upload is accurate and that you have the right to share it with us.
E-Planner may offer free and paid subscription tiers. The features available under each tier, and the applicable fees, are described on our pricing page.
Subscription fees are billed in South African Rand (ZAR) in advance, either monthly or annually depending on the plan you choose. All fees are non-refundable except where required by law.
We will give you at least 30 days' written notice before changing subscription prices. Continued use of a paid plan after the notice period constitutes acceptance of the new price.
You must not use E-Planner to:
- upload false, fraudulent, or misleading estate information
- facilitate money laundering, tax evasion, or any activity prohibited under the Financial Intelligence Centre Act (FICA)
- attempt to reverse-engineer, copy, or scrape any part of the platform
- access another person's account without authorisation
- use the platform in any way that breaches applicable law
We reserve the right to suspend or terminate accounts that violate these restrictions and to refer suspected illegal activity to the relevant authorities.
All content, design, software, and trademarks on the E-Planner platform belong to E-Planner and its Founders. Nothing in these Terms grants you any right to use our intellectual property other than as necessary to use the platform for its intended purpose.
To the maximum extent permitted by South African law, E-Planner is not liable for:
- any loss or damage arising from your reliance on content generated by the platform
- the legal invalidity of any estate document produced using the platform
- any loss of data resulting from events beyond our reasonable control
- any indirect, consequential, or special loss
Our total liability to you in any 12-month period shall not exceed the total fees you paid to us in that period. Nothing in this clause limits our liability for fraud or for any liability that cannot be excluded under the Consumer Protection Act 68 of 2008.
We may update these Terms from time to time. If we make material changes, we will notify you by email at least 14 days before the changes take effect. Continued use of the platform after that date means you accept the updated Terms.
The current version of these Terms is always available at /terms.
You may close your account at any time from your account settings. On closure, we will delete your personal information in accordance with our Privacy Policy and applicable law.
We may suspend or terminate your account immediately if you breach these Terms, or on 30 days' notice for any other reason.
These Terms are governed by the laws of the Republic of South Africa. Any dispute that cannot be resolved informally will be referred to the jurisdiction of the South Gauteng High Court, Johannesburg, unless the Consumer Protection Act requires otherwise.
Before initiating formal proceedings, both parties agree to attempt good-faith resolution through our internal complaints process at info@e-planner.co.za.
